Definitions

For the purposes of these Terms and Conditions:

Bloom Gymnastics refers to Bloom Gymnastics Pty Ltd ABN 32697646996, including its directors, employees, coaches, contractors and authorised representatives.

Participant means any person enrolled in a class, program, event or activity conducted by Bloom Gymnastics. As the Participant is under 18 years of age, any reference to the Participant also includes their parent or legal guardian who has completed the enrolment.

Parent/Guardian means the person legally responsible for the Participant who has accepted these Terms and Conditions on the Participant's behalf.

Venue means any location used by Bloom Gymnastics to deliver its services, including the gymnastics training areas, reception, spectator areas, amenities and surrounding car parks.

By completing an enrolment, the Member acknowledges that these Terms and Conditions form the complete agreement between themselves and Bloom Gymnastics Pty Ltd. Any information or advice provided verbally by staff is intended as guidance only and does not amend these Terms and Conditions unless Bloom Gymnastics confirms the change in writing.

In Writing means communication sent by email or by post to Bloom Gymnastics Pty Ltd.

Membership

Enrolment is subject to class availability and acceptance by Bloom Gymnastics. A Participant's place is confirmed once enrolment is complete, all required information has been provided, and the applicable fees have been paid.

Enrolments are ongoing until cancelled. To cancel an enrolment, Members must provide at least 30 days' written notice. You may email your notice to us at admin@bloomgymnastics.com.au or by mail

At enrolment, Members must pay any applicable joining or registration fee, along with the first two (2) weeks' tuition fees, and provide a valid Direct Debit Authority. The Direct Debit Authority must remain active while the enrollment is current.

Tuition fees are charged in advance according to our billing schedule. Members are responsible for ensuring sufficient funds are available on each payment date.

Holiday programs, special events and other optional activities may incur additional fees. Participation is subject to availability, payment by the advertised due date, and the Member's account being up to date.

Classes

Bloom Gymnastics offers recreational gymnastics programs throughout the year. Class days, times, locations and availability may change from time to time and will be updated on our website and parent portal.

We may make reasonable changes to class schedules, coaches or programs where required. If a change significantly affects your enrollment, we will notify you as soon as reasonably possible.

Occasionally, regular classes may be replaced with special activities, skill assessments, showcase events or other club activities.

A class position is reserved while your enrollment is active and fees are up to date. If your enrollment is cancelled or your account falls into arrears, we may offer your place to another participant.

Public Holidays and Centre Closures

Bloom Gymnastics does not operate on Queensland gazetted public holidays.

We also close for two weeks over the Christmas period, including the week before Christmas and the week after Christmas.

Closure dates will be communicated to Members in advance.

Missed Classes

We understand that Participants may occasionally miss a class due to illness, school commitments or family circumstances.

Missed classes are not eligible for refunds or credits. However, if you notify us before the scheduled class using the parent portal, you may book a make-up class, subject to availability.

Make-up classes are valid for 1 month while the Participant's enrollment remains active. Once a make-up class has been booked, it cannot be changed or rescheduled. Any unused make-up classes will be forfeited when an enrolment ends.

Privacy and Confidentiality

Bloom Gymnastics collects, stores and manages personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth).

Personal information is collected only for purposes related to enrolment, class participation, communication, payment processing and the delivery of our services. We will only disclose personal information where required by law or where necessary to administer your enrollment or provide our services.

Refunds

New Members may request a full refund within 14 days of their enrolment for any reason. This includes any joining or registration fee and any tuition fees paid. Refund requests must be made in writing and will be processed to the original payment method or a nominated bank account.

After the initial 14-day period, fees paid are generally non-refundable. Any approved refunds are at the discretion of Bloom Gymnastics and will be assessed on a case-by-case basis.

Nothing in these Terms and Conditions limits or excludes your rights under the Australian Consumer Law.

Child Safety

Bloom Gymnastics is committed to providing a safe, inclusive and supportive environment where every child feels respected, valued and protected.

We have zero tolerance for child abuse, neglect, bullying, harassment or any behaviour that places a child at risk. All staff and volunteers are expected to uphold our Child Safe policies and comply with relevant child safety legislation, including maintaining valid Blue Cards where required.

Parents, guardians, participants and visitors are expected to behave in a way that supports the safety and wellbeing of all children. Any behaviour that compromises the safety, welfare or enjoyment of others may result in removal from the venue or cancellation of enrolment.

If you have any concerns about the safety or wellbeing of a child, please notify a Bloom Gymnastics staff member as soon as possible.

Media Consent

Bloom Gymnastics may take photos or videos during classes, events and other club activities for promotional, marketing and educational purposes.

By enrolling, Members consent to the use of the Participant's image in Bloom Gymnastics publications, website and social media. Consent may be withdrawn at any time by notifying Bloom Gymnastics in writing. We will make reasonable efforts to respect your request from the date it is received.

If you do not wish for your child's photos or videos to be used in Bloom Gymnastics' promotional material, website or social media, please notify us in writing at the time of enrolment. You may withdraw your consent at any time by notifying us in writing.

Parent and Visitor Behaviour

Bloom Gymnastics is committed to providing a safe, positive and respectful environment for all participants, families, staff and visitors.

Parents, guardians and visitors are expected to treat everyone with respect. Any concerns or feedback should be communicated in a calm and respectful manner.

Bloom Gymnastics has zero tolerance for abusive, threatening, aggressive, intimidating, discriminatory or harassing behaviour towards staff, coaches, volunteers, participants or other members. This applies to behaviour in person, by phone, email, social media or any other form of communication.

If these expectations are not met, Bloom Gymnastics may ask a person to leave the venue, suspend or cancel an enrollment, or take any other action necessary to protect the safety and wellbeing of our community.

Assumption of Risk

By enrolling in a Bloom Gymnastics program, Members acknowledge that participation in recreational gymnastics involves inherent risks and may result in injury. While Bloom Gymnastics takes reasonable steps to provide a safe environment and qualified supervision, no activity is completely risk free. By participating, Members accept these inherent risks.

Direct Debit Service Agreement

By enrolling with Bloom Gymnastics Pty Ltd and providing your payment details, you authorise us, or our nominated direct debit provider, to debit your nominated account or card for fees and charges relating to your enrolment.

Payment Schedule

  • Tuition fees will be debited in accordance with Bloom Gymnastics' current billing schedule.

  • Additional fees for holiday programs, events, merchandise or other optional activities will only be charged where you have registered for or authorised the purchase.

  • Any changes to fees or billing arrangements will be communicated in advance.

Your Responsibilities

You agree to:

  • provide accurate and up-to-date payment details;

  • ensure sufficient funds are available on each payment date;

  • keep your payment details current; and

  • pay any outstanding fees if a payment is declined.

A $10 missed payment fee will apply to all declined or unsuccessful direct debit payments. If you are unable to make a payment on time, please contact Bloom Gymnastics as soon as possible so we can discuss your options and help you keep your enrollment active.

Bloom Gymnastics reserves the right to suspend participation if fees remain unpaid.

Changes to Your Enrolment

Changes to your class or enrollment may affect your fees. Any fee adjustments will be reflected in future direct debit payments.

Cancelling Direct Debit

Cancelling your Direct Debit Authority does not cancel your enrollment. To end your enrollment, you must provide the required written notice in accordance with these Terms and Conditions.

You may update or cancel your Direct Debit Authority by contacting Bloom Gymnastics before your next scheduled payment.

Membership cancellation 

To cancel an enrollment, at least 30 days' written notice is required. Direct debit payments will continue during the notice period.

Not attending classes does not cancel an enrollment or stop payments.

Bloom Gymnastics may suspend or cancel an enrolment if fees remain unpaid or these Terms and Conditions are breached.

Payment Enquiries

If you believe an incorrect payment has been processed, please contact Bloom Gymnastics as soon as possible so we can investigate and resolve the issue. If an error has occurred, any necessary adjustment or refund will be processed promptly.

Privacy

Payment information is managed securely in accordance with applicable Australian privacy laws and is only used for the purposes of processing payments and administering your enrolment.

Medical suspensions

Payment suspensions are available if a Participant is unable to attend classes due to a serious illness or injury for more than two (2) consecutive weeks. A valid medical certificate is required to support the request.

Class positions cannot be held during a payment suspension. When the Participant is ready to return, a new enrolment is required. While we will do our best to accommodate your preferred class, we cannot guarantee the same day or time will be available. Please contact Reception to discuss availability before re-enrolling.

Contact Us

For any enquiries about your enrolment, account or direct debit, please include the Participant's full name and date of birth.

If you need to update your payment details or cancel your direct debit, please contact us at least 7 business days before your next scheduled payment.

By providing your payment details, you authorise Bloom Gymnastics Pty Ltd, or our nominated payment provider, to debit your nominated account in accordance with these Terms and Conditions and the Direct Debit Service Agreement.

Acknowledgment

By enrolling with Bloom Gymnastics Pty Ltd, I confirm that I have had access to and the opportunity to read the Terms and Conditions and the Direct Debit Service Agreement.

I understand these documents form the agreement for my child’s participation and my payment obligations.

If I wish to cancel after 48 hours of receiving these documents, I can do so at any time by notifying Bloom Gymnastics in writing.

I understand it is my responsibility to read and understand all enrolment terms.

Amendments by Us

We may update or change these Terms and Conditions from time to time, including fees, policies or enrolment conditions.

Where changes are made, we will provide Members with at least 14 days’ notice by email or another reasonable method of communication.

Continued enrolment after the notice period means you accept the updated Terms and Conditions. If you do not agree to any changes, you may cancel your enrollment in accordance with the cancellation terms.
